O Decreto nº 8374/2014, publicado no Diário Oficial no dia 12/12/2014, estabelece a possibilidade de protocolizar os processos de Transformação de Visto Temporário em Permanente diretamente no Ministério da Justiça, em Brasília, da mesma forma como são atualmente protocolizados os processos de Prorrogação de visto temporário. Desta forma, os processos de Transformação podem agora ser protocolizados tanto na Polícia Federal
quanto no Ministério da Justiça.
As principais vantagens de se fazer o protocolo diretamente no Ministério da Justiça são a redução do tempo de análise dos casos, uma vez que se evitará o lapso de tempo necessário para que a Polícia Federal local remeta os processos ao Ministério da Justiça para análise, bem como a desburocratização da protocolização dos processos em si, dado que não será necessário a apresentação de passaportes originais, tampouco a presença dos candidatos no Ministério, sendo permitido que procuradores protocolizem o processo.
No caso do processo ser protocolizado no Ministério da Justiça, o candidato e seus familiares receberão um protocolo em papel, o qual garante a estada legal até o julgamento final do processo. Se a protocolização ocorrer na Polícia Federal, o candidato e seus familiares receberão os protocolos da forma usual, por meio de carimbo em passaporte. Ambos os protocolos têm o mesmo valor legal.
O Ministério da Justiça confirmou já ser possível a protocolização diretamente em sua sede.
Brazilian government changes procedure for filing processes of Transformation of Temporary Visas into Permanent
The Decree No. 8374/2014, published in the Official Gazette on December 12th 2014, brings the possibility to file the transformation processes directly in the Ministry of Justice in Brasília, in the same way as it currently happens to Temporary Visas Extensions. In this way, the transformation processes can now be submitted either at the local Federal Police as directly in the Ministry of Justice.
The main advantages of making the filing directly at the Ministry of Justice are to reduce cases analysis time, as it will prevent the lapse of time required for the local Federal Police refer the cases to the Ministry of Justice for analysis and as reducing bureaucracy of filing of the processes itself, as the presentation of original passport is not required, nor the presence of the candidates in the Ministry, being allowed third parties to submit the process on the candidate’s behalf.
If the process is filed directly with the Ministry of Justice, the candidate and their families will receive a protocol on paper, which guarantees the legal stay until the final judgment of the case. If the filing occurs in the Federal Police, the candidate and their families will receive the protocols in the usual way, with a stamp in passport. Both protocols have the same legal value.
The Ministry of Justice has confirmed that the filing directly at their site is already being executed.
