A existência de prole brasileira não impede a expulsão de estrangeiro do país

Em recente julgado, o Superior Tribunal de Justiça (STJ) entendeu que não constitui impedimento à expulsão do estrangeiro a mera existência de filhos ou netos brasileiros1 Muito embora a Justiça brasileira busque atender o interesse do menor a fim de tutelar a família, a criança e o adolescente, recentes julgados e mais especificamente neste último, os tribunais vêm exigindo a efetiva comprovação da dependência econômica e da convivência socioafetiva com a prole brasileira.
No presente caso, o STJ entendeu que a mera apresentação de fotos como meio de prova não evidencia os laços afetivos e de dependência; não constituindo, portanto, impedimento à expulsão de uma estrangeira que possuía filhos e netos brasileiros.

The existence of brazilian offpsring does not prevent the foreigner expulsion of the country

In a recent judgment, the Brazilian Superior Court of Justice (STJ) understood that the mere existence of Brazilian children or grandchildren does not prevent the foreigner expulsion of the country.
Although the Brazilian Justice seeks meet the interests of the child in order to protect the family, children and adolescents, recent decisions have demanded proof of the effective economic dependence and the social affective relationship with the Brazilian offspring. In the present case, the Superior Court of Justice held that mere photos, as evidence, do not prove emotional ties and dependency. Therefore, it does not prevent the expulsion of a foreigner who has Brazilian children or grandchildren.
